Welcome to TerraLink. These Terms & Conditions ("Terms") govern your access to and use of the TerraLink website, marketplace, and digital products (collectively, the "Platform"). By creating an account, browsing listings, or purchasing any resource, you agree to these Terms. If you do not agree, please do not use the Platform.

1. About TerraLink

TerraLink is a Malaysian platform built around land. The Platform offers three distinct services:

• Land listings — a marketplace where users list and discover land for sale or rent. TerraLink is not a party to any land transaction.
• Third-party physical products & services — a marketplace of equipment, infrastructure, homestead solutions, and professional services offered by independent third-party vendors. TerraLink is not the seller or service provider.
• TerraLink digital resources — templates, checklists, guides, calculators and bundles created, owned and sold directly by TerraLink.

TerraLink is a marketplace and content platform. We are not a real estate agency, valuer, financier, conveyancer, or law firm, and we do not provide legal, financial, tax, or investment advice.

2. Eligibility & Accounts

• You must be at least 18 years old and legally capable of entering into binding contracts under Malaysian law.
• You are responsible for the accuracy of the information you provide and for keeping your login credentials confidential.
• You are responsible for all activity that occurs under your account.
• We may suspend or terminate accounts that breach these Terms, post unlawful content, or misuse the Platform.

3. Land Listings

Users may post land listings ("Listings") subject to these Terms. By posting a Listing, you represent that:

• You have the legal right to offer the land for sale, lease, or the activity described.
• All information — including title status, land area, zoning, encumbrances, price and photographs — is accurate, current, and not misleading.
• You will promptly update or remove a Listing that is no longer accurate or available.

TerraLink does not verify, endorse, or guarantee any Listing, user, price, title, measurement, or representation made on the Platform. All land transactions are between users; TerraLink is not a party to any sale, lease, or other agreement entered into via the Platform.

4. Third-Party Products & Services

The Platform features physical products and services ("Third-Party Offerings") supplied by independent vendors ("Vendors"). TerraLink acts solely as a marketplace and is not the seller, manufacturer, importer, installer or service provider for any Third-Party Offering.

• Vendors are responsible for the accuracy of their listings, pricing, stock availability, specifications, delivery, installation, warranties, and after-sales support.
• Any contract for a Third-Party Offering is formed directly between you and the Vendor, and may be subject to the Vendor's own terms.
• Returns, refunds, exchanges, defects, and service complaints for Third-Party Offerings must be raised with the Vendor in the first instance, subject to applicable Malaysian consumer protection law.
• TerraLink does not verify, endorse, or guarantee any Vendor, Third-Party Offering, claim, certification or representation made on the Platform.

5. Due Diligence

Land and product transactions can carry significant legal and financial risk. You are solely responsible for conducting your own due diligence before entering into any transaction — including verifying title, ownership, zoning, restrictions, charges, planning approvals, vendor credentials, product specifications and certifications — and engaging qualified Malaysian professionals (advocates and solicitors, licensed valuers, surveyors, accountants, engineers, and licensed real estate negotiators) as appropriate.

6. TerraLink Digital Resources

TerraLink creates, owns and sells digital resources such as templates, checklists, guides, calculators and bundles ("Digital Products"). Digital Products are sold directly by TerraLink, not by a third-party vendor. Unless stated otherwise:

• Digital Products are licensed, not sold. You receive a non-exclusive, non-transferable, personal licence to use the file for your own internal or personal use.
• You may not resell, redistribute, sub-licence, or publicly share the files.
• Digital Products are provided for educational and practical reference only and are not a substitute for professional legal or financial advice. Use them at your own risk and adapt them to your circumstances with appropriate professional input.
• Access to purchased files is available in your TerraLink account dashboard under Downloads.

7. Payments

Prices are displayed in the currency shown at checkout and are inclusive of applicable taxes unless stated otherwise. Payments are processed by Stripe, our third-party payment provider. TerraLink does not store complete payment card details on its servers. Your use of payment services is subject to Stripe's terms and privacy policy.

8. Refunds

Refunds for TerraLink Digital Products are governed by our Refund Policy. In summary, digital purchases are final and non-refundable once access has been delivered, except in limited situations such as duplicate charges, inaccessible files, or billing errors. Refunds, returns and warranties for Third-Party Offerings are handled by the relevant Vendor under their own terms and applicable Malaysian consumer protection law.

9. Acceptable Use

You agree not to:

• Post false, fraudulent, misleading, or unlawful content, including fake listings, duplicated Listings, or misrepresented products or services.
• Use the Platform to harass, defraud, or harm other users or Vendors.
• Scrape, copy, or republish Listings, Third-Party Offerings, Digital Products, or other Platform content without permission.
• Attempt to gain unauthorised access to the Platform, interfere with its operation, or circumvent security features.
• Use the Platform in breach of any Malaysian law, including housing, land, anti-money-laundering, consumer protection, and data protection laws.

10. Intellectual Property

The TerraLink name, logo, website design, source code, and Digital Products are owned by or licensed to TerraLink and are protected by Malaysian and international intellectual property laws. You retain ownership of content you submit (such as Listings, Vendor product information and photographs) and grant TerraLink a worldwide, royalty-free licence to host, display, and promote that content on the Platform.

11. Disclaimer

The Platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by Malaysian law, TerraLink disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy of Listings or Third-Party Offerings, title, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure.

12. Limitation of Liability

To the maximum extent permitted by law, TerraLink, its directors, employees, and contractors will not be liable for any indirect, incidental, consequential, special, or exemplary damages, or for any loss of profits, revenue, data, goodwill, land transactions, or losses arising from Third-Party Offerings arising out of or in connection with your use of the Platform. Our total aggregate liability to you for any claim relating to the Platform is limited to the amounts you paid to TerraLink (excluding amounts paid to Vendors) in the 6 months preceding the event giving rise to the claim.

13. Indemnity

You agree to indemnify and hold TerraLink harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising out of your Listings, your Vendor offerings, your transactions with other users or Vendors, your breach of these Terms, or your violation of any law or third-party right.

14. Third-Party Services

The Platform may link to or rely on third-party services (including Stripe, Vendors, and mapping providers). TerraLink is not responsible for the content, policies, or practices of any third-party service.

15. Changes to the Terms

We may update these Terms from time to time. Material changes will be communicated by updating the "Last updated" date above and, where appropriate, via the Platform or email. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of Malaysia. The courts of Malaysia have exclusive jurisdiction over any dispute arising out of or in connection with these Terms or your use of the Platform.
